  • What is Mediation?
    The term mediation broadly refers to any instance in which a neutral third party (the mediator) helps parties to a lawsuit reach an agreement in the form of a contract. The process is private, confidential, and is enforced by law. The parties meet (usually via ZOOM) and the mediator facilitates communication between the parties in a neutral and forward-looking manner. One of the benefits of mediation is that it can eliminate the need to go to trial, thus decreasing not only the time but the costs associated with litigation. In addition, parties may discuss issues that are not allowed at trial due to evidentiary rules. Furthermore, the parties come to their own agreement and control the outcome of mediation. Going before a judge or jury may not result in the best outcome for the parties.
